Old Liquors Terms & Conditions

 

The following are the terms and conditions (the “Old Liquors Terms and Conditions”) under which you (a “User”) may use the website of Old Liquors (“Old Liquors” or “we” or “us” or other similar pronouns)  at www.oldliquors.com and/or any other addresses (any or all of which are herein referred to as the “Website”). Please read this page carefully. We may change the Terms and Conditions from time to time, at any time without notice to you, by posting such changes on the Website. By accessing, using, browsing or ordering on the Website, you accept and agree to be bound by these Terms and Conditions. If you do not accept any of the provisions of the Terms and Conditions, do not use the Website. By using this website you irrevocably agree with these terms and conditions as mentioned here.

 

1. Copyright

No photography, imagery, text, source code or any other material shown on the Website may be used in any circumstances for commercial purposes, nor may any of our material herein be altered, cropped, transformed, built upon, or in any other way changed or reproduced, whether from our own website or copied from third party website in breach of this conditions themselves or otherwise redistributed without our prior written permission. Your use of the Website does not grant you ownership of any content, software, code, data or materials you may access on the Website. Old Liquors will enforce its intellectual property rights to the fullest extent of the law, including the seeking of criminal prosecution.

 

2. Disclaimer

The Website may contain links to third-party websites that are maintained by others. These links are provided solely as a convenience to you and not as an endorsement by us of the contents of such third-party websites. We are not responsible for any disruption, offence or damage caused by following any links from Old Liquors to any third-party websites and or vice versa. We do not make representations regarding the content or accuracy of materials on such third-party websites. If you decide to access linked third-party websites, you do so at your own risk.

 

3. Reseller

In consideration of your use of the Website, you agree to: (a) provide true, current, accurate and complete information about yourself and your company as prompted by any enquiry form that you may fill out on the Website (hereby referred to as “Registration Data”) and (b) maintain and update the Registration Data to keep it true, current, accurate and complete by contacting us. If a User provides any Registration Data that is untrue, not current, inaccurate or incomplete or we have the grounds to suspects that any Registration Data is as such, we have the right to suspend or terminate your account and refuse any and all current or future use of the Website (or any portion thereof). Any placed orders by the User will not be fulfilled.

You are responsible for maintaining the confidentiality of your account, and are fully responsible for all activities that occur under account. You agree to immediately notify Old Liquors  of any unauthorized use of your password or account or any other breach of security. We will not be liable for any loss or damage arising from your failure to comply with this paragraph.

 

4. Payment methods

Payment can be made by debit or credit card, using the following cards: VISA, Mastercard, American Express or Meastro. Payment by credit card is handled by Paypal and an additional charge of 3,9% will be charged over the total amount. You must give us authority for payment to complete your order. All card holders are subject to validation checks and authorization by the card issuer. If your card issuer refuses to authorize payment to us, we cannot accept your order and will not be liable for any delay or non-delivery. We will not deliver any products prior to these checks and authorizations being completed. You can also pay by bank transfer or Letter Of Credit (LOC) if you wish by prior arrangement, in which case you must contact us before transferring any money. Please be aware that there may be an administration charge for this service depending on your country of origin. Your bank may charge you for this service separately.

 

5. Minimum legal age

We may only sell alcohol products to those over the age of 18. By placing an order on our Website, you confirm that you are at least 18 years of age or above the minimum legal age for purchasing alcohol products in your country of residence.

 

6. Taxes and duties

Value Added Tax (VAT) is not applicable since the bottles originate from a private collection. Your order may be subject to local tax and duties upon arrival in the designated country, which are levied once the package reaches customs clearance. Any additional charges for customs clearance must be borne by the recipient; we have no control over these charges and cannot predict what they may be. Customs policies vary widely from country to country, so you will need to contact your local customs office in your country of landing for further information.

 

7. Products

Each product has its own individual picture(s). It is our policy to ensure that you receive the exact same product that is shown on the Website. If you feel you may have received a different bottle than the product you have ordered, please contact us immediately. If a product may vary from the shown picture, this will be explicitly noted in the product information. By purchasing a product that differs from the picture(s), you agree to be aware of small differences (e.g. label, cork, wax) and cannot hold Old Liquors responsible if you are unsatisfied with the differences.

Various products contain cellar dust, gathered during the many years of storage. Cellar dust is easily removable in most cases. Cellar dust on badly stained bottles may be more difficult to remove. Products are sent in their original state: in no circumstances does Old Liquors remove cellar dust.

For quality control reasons products are registered and photographed before being packaged and shipped.

 

8. Explanation of abbreviations

Old Liquors uses several abbreviations in its product descriptions. The following abbreviations are explained:

  • OPB: Original Presentation Box
  • OWC: Original Wooden Case
  • OC: Original Carton
  • RC/RW: Recorked and Rewaxed
  • OC/RW: Original Cork and Rewaxed

 

9. Quality control

Please note that not all products on the Website are in the bottles and or presentation material as shown and have been purchased by us as seen from known and reliable suppliers (provenance and well-known auction houses). We are unable to give any guarantees on unopened products because each product had (several) unknown owners in the past.

If you have any doubt about the quality of the content has strongly regressed and or does not match the label/product description, you can authorize Old Liquors to permit us to examine the purchase by uncorking. Examination consists of testing the condition and alcohol strength with a minimum of 25%. If the quality has indeed regressed, we will refund your purchase immediately. If the quality has not been affected to our standards, the product will be recorked, sealed and/or waxed according to the original packaging.

Please note that opinion-based attributes as color, nose and taste are no attributes for quality. Returns based on these attributes will not be taken into consideration.

 

10. Transportation and delivery

All orders are delivered Ex Works. The minimum order amount is £ 750, excluding costs of transportation. VAT is not applicable as the bottles originate from a private collection. The buyer is responsible for all transportation costs and also bears the insurance and/or risks for bringing the goods in good order to their final destination. Old Liquors does not load goods on collecting vehicles and does not clear them for export. Please contact Old Liquors if you have any special requirements concerning your delivery.


It is our policy that all products supplied to all our customers arrive in perfect condition. All products are packed carefully with protective material to prevent any damage. Despite all taken measures there is still a possibility that damage can occur beyond our control during transportation. Old Liquors is not responsible for any damage done to the products during transportation. It is the obligation of the buyer to verify the condition of the products immediately upon delivery. It is your responsibility and your option to insure your shipment at additional costs. Please contact your insurance company for more information.

Full and proper invoice and delivery address must be provided at the time of ordering. After processing, orders may be subject to delay if any order or part of an order is unavailable, in which case Old Liquors will notify the customer. All consignments carry a copy of the consignment note and invoice.

Please note that standard deliveries are made during business hours from Monday to Friday; to ensure prompt delivery someone must be present to sign for the parcel. For this reason Post Office box numbers will not be accepted as a delivery address and any such information will create delays and may incur additional costs.

After confirmation of the order once payment has been received, the order is dispatched within 48 hours. For international orders, delivery times vary depending on location. Delivery charges are calculated based on the weight of the product(s) and destination address. Old Liquors cannot make guarantees concerning delivery times and is not responsible for delayed orders.

Once the package has left our warehouse by handing over to the transportation company, the goods are out of our responsibility and considered to be delivered to the costumer, irrespective which circumstances are leading to losses, missing, damage or confiscation of the goods, whatever the reason. Each delivery of our products is subject to local tax and duties upon arrival in the designated country, which are levied once the package reaches customs clearance. It is therefore your full responsibility to verify any import regulations upon arrival your designated country.

Any additional charges for customs or other kind of clearance must be borne by the recipient; we have no control over these charges and cannot predict what they may be. Customs policies vary widely from country to country, so you will need to contact the recipient’s local customs office in your country of landing for further information.

 

11. Availability and pricing

Old Liquors have endeavored to ensure the accuracy of the information on the Website. Should a product be unavailable, we will endeavor to inform you of this promptly. Prices and specifications can change without notice and products are subject to availability.

Incorrect pricing in the system can occur on the Website and can be changed by Old Liquors. You can never derive us these rights, even if an order has already been placed. If our system displays an incorrect price, then we shall notify the partner by e-mail. The additional amount that has to be paid will be listed in this e-mail. You have the choice to accept this change or abandon the purchase. In latter case, we will remove the order from our systems.

 

12. Continuity of access/service

Our objective is to offer our customers the best possible service, but we are unable to accept responsibility for interrupted access to the Website due to technical problems outside of our control. Due to the nature of the Internet, access may be suspended, restricted or interrupted at any time, and we are therefore unable to guarantee entirely error-free access and services.

 

13. Identity verification

To ensure that your credit, debit or charge card is not being used without your consent, we will validate name, address and other personal information supplied by you during the payment process against appropriate third party databases. By accepting these terms and conditions you consent to such checks being made.

In performing these checks personal information provided by you may be disclosed to a registered Credit Reference Agency which may keep a record of that information. You can rest assure that this is done only to confirm your identity, that a credit check is not performed  and that your credit rating will be unaffected. All information provided by you will be treated securely and strictly in accordance with the Data Protection Authorities.

 

14. Data protection

We take steps to protect your privacy and support all the requirements of the Data Protection Authorities. The data we collect from you is used solely for the purpose of fulfilling your order. We will never disclose your information to any other parties without your consent except to verify your identification as above. Your credit card information is not retained and is completely removed from our system after your order is processed. You have every right to know what information has been held in our system.
